FEES - ARBITRATION

Arbitrations are typically billed on a per diem basis for each hearing day booked with any additional time, including time engaged in the writing of the award, being billed on an hourly basis. Each day booked covers a seven hour day (usually 10:00 AM to 5:00 PM) and one budgeted hour of prehearing telephone conferencing.

Per diems for the National Capital Region, Kingston and Montreal:

Roger Beaudry – Per diem $2,200
Joy Noonan – Per diem $2,000

Per diems for Toronto:

Roger Beaudry – Per diem $2,700
Joy Noonan – Per diem $2,500

Per diems for other parts of Ontario and Quebec:

Roger Beaudry – Per diem $2,950
Joy Noonan – Per diem $2,750

What is included in the per diem: administration, travel time, travel expenses and one hour of pre-hearing telephone conferencing per day booked.

What is NOT included in the per diem: applicable GST, the cost of the facilities in which the arbitration is conducted, adjournment/cancellation fees, pre-hearing conference time in excess of one hour per day of hearing time booked, and time engaged in writing the award.

Cancellation/Adjournment Fees:

If notice of cancellation or adjournment is received at least SEVEN BUSINESS DAYS IN ADVANCE of the scheduled commencement of the hearing: No charge for the hearing time booked. However, we do charge for any time engaged in pre-hearing conferences (whether it would or not have been covered by the per diem) at $330.00 per hour plus GST. We also invoice any cost of cancelling travel arrangements.

In all other cases: One half of the per diem time booked plus any pre-hearing conference time that would not have been covered by the per diem billed at $330.00 per hour plus GST. We also invoice any cost of cancelling travel arrangements

Time engaged by the arbitrator in excess of the time covered by the per diem:

Any time engaged beyond the time covered by the per diem is billed at $330.00 per hour (plus GST).

Facilities:

The parties are responsible for the cost of the facilities in which the arbitration is conducted. We have facilities in Ottawa and Toronto that we can make available to the parties. In Ottawa the cost of that space is $450 per day. In Toronto the cost is $600.

Other:

The parties share fees, cancellation/adjournment fees and disbursements equally unless a different distribution is provided for by law, agreement or court order. In the absence of a retainer being provided to the arbitrator, the law firm representing a party is responsible for that party’s share of fees, cancellation/adjournment fees and disbursements and for recovering these from the client.
