FEES - MEDIATION

Mediations are typically billed on a day or half day flat fee basis. The full day flat fee covers all preparation and a seven hour session (usually 10:00 AM to 5:00 PM). The half day flat fee covers all preparation and a three hour session (usually 10:00 AM to 1:00 PM or 2:00 PM to 5:00 PM).

Flat fee in the National Capital Region, Kingston and Montreal:

Roger Beaudry – Full day $2,200 | Half Day: $1,100
Joy Noonan – Full Day $2,000 | Half Day: $1,000

Flat fee in Toronto:

Roger Beaudry – Full day $2,700
Joy Noonan – Full Day $2,500

Flat fee in other parts of Ontario or Quebec:

Roger Beaudry – Full day $2,900
Joy Noonan – Full Day $2,700

What is included: administration, pre-mediation preparation and consultation, and mediator travel time and expenses.

What is NOT included: applicable GST, the cost of the facilities in which the mediation session is conducted, adjournment/cancellation fees, and any time engaged by the mediator in session in excess of the time booked.

Cancellation/Adjournment Fees:

NO CHARGE: If notice of cancellation or adjournment is received at least FIVE BUSINESS DAYS IN ADVANCE of the scheduled commencement of the mediation session.

ONE HALF OF THE FLAT FEE + GST: In all other cases.

Time engaged by the mediator in session in excess of the time originally booked:

Any time engaged in session beyond the time that was originally booked is billed at $330.00 per hour (plus GST).

Facilities:

The parties are responsible for the cost of the facilities in which the mediation session is conducted. We have facilities in Ottawa and Toronto that we can make available to the parties. In Ottawa the cost of that space (suitable for a total of 5 persons - two from each side plus the mediator) is $450. In Toronto the cost is $600. In a very significant number of the mediations we conduct the parties make their own arrangements for facilities.

Other:

The parties share fees, cancellation/adjournment fees and disbursements equally unless a different distribution is provided for by law, agreement or court order. In the absence of a retainer being provided to the mediator, the law firm representing a party is responsible for that party’s share of fees, cancellation/adjournment fees and disbursements and for recovering these from the client.
